Russian Ministry of Defence Could Have Violated Antimonopoly Law
OREANDA-NEWS. May 24, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Defence of the Russian Federation upon the signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
The case was opened upon a petition of “Promelectronika” Concern” Research-and-Production Association” CJSC about actions undertaken by the Ministry.
FAS Russia suspects that the Ministry could have violated the antimonopoly law by initiating and carrying out additional inspections of the quality of the products of “Promelectronika” Concern” Research-and-Production Association” CJSC. These inspections are not provided for by the existing procedures. The products in question have passed all mandatory government testing and are subject to supply under a government contract concluded with the Russian Ministry of Defence.
According to the petitioner, structural units of the Ministry deliberately prevent sale of the company products to the benefit of its direct competitor – “NaviDas” Research-and-Technical Enterprise” OJSC, which earlier supplied similar products”.
The case is scheduled for 27th June 2011.

Part 1 Article 15 of the Federal Law “On Protection of Competition” prohibits federal executive bodies, the authorities of the constituent territories of the Russian Federation, local self-government bodies, other bodies or organizations that exercise the functions of the above bodies, as well as state extra-budgetary funds, the Central Bank of the Russian Federation to pass acts and (or) exercise actions (omissions) that lead or can lead to preventing, restricting, eliminating competition, except cases of passing acts and (or) exercising actions (omissions) provided for by the federal laws.
