FAS Suspects Atomkomplekt Violated Antimonopoly Law
OREANDA-NEWS. May 10, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against “Atomkomplekt” OJSC (the group of persons of “Rosatom” State-Run Corporation) upon the signs of violating Part 1 Article 17 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
The case was initiated upon a complaint of “Vysokovoltnie Elektricheskie Sistemy” Ltd. against actions of “Atomkomplekt” OJSC in course of a tender organised by “Atomkomplekt” OJSC for the right to conclude a contract for supplying gas-insulated switchgear and control gear (220 kv, 500 kv) for NDAES-2.
According to the tender documentation, for 2009 and the nine months of 2010 a bidder must had a turnover equal to 1,129,661,000 Rubles.
According to FAS Russia, “Atomkomplekt” OJSC unreasonably set the minimum threshold value for turnover of potential tender bidders at 1,129,661,000 Rub, which resulted in restricting competition in course of organising the tender by reducing the number of economic entities that have a possibility to take part in the tender and arrange the required supplies.

Part 1 Article 17 of the Federal Law “On Protection of Competition”prohibits actions in course of competitive bidding that lead or can lead to preventing, restricting or eliminating competition, particularly by creating preferential conditions for a bidder or several bidders taking part in competitive bidding.
