OREANDA-NEWS. May 06, 2011. The Federal Antimonopoly Service (FAS Russia) found that “Sheremetyevsky” Integrated Vacation Retreat” Federal State Enterprise violated Part 1 Article 17 of the Federal Law “On Protection of Competition” (prohibiting competition-restricting actions in course of competitive bidding), reported the press-centre of FAS Russia.

FAS Russia received a petition of “Fresh-Fitness” Ltd. that “Sheremetyevsky” Integrated Vacation Retreat” Federal State Enterprise refused to allow “Fresh-Fitness” Ltd. to bid at the auction because it had failed to submit the complete package of documents required to take part in the auction. “Fresh-Fitness” Ltd. did not submit a decision about approval or completion of a large transaction, which should have been included in its application to bid at the auction.

However, “Fresh-Fitness” Ltd. submitted a protocol of a general members meeting, which contained a unanimous decision to take part in the auction and conclude the lease contract should the company win the auction. Under the current law, a decision to approve a large transaction must be made by a general members meeting. The FAS Russia’s Commission concluded that the decision of “Fresh-Fitness” Ltd. contained all necessary information and the protocol of a general members meeting was a decision on approval or completion of a large transaction.

Therefore, FAS Russia established that refusal of “Sheremetyevsky” Integrated Vacation Retreat” Federal State Enterprise to allow “Fresh-Fitness” Ltd. to bid at the auction was unlawful and found that “Sheremetyevsky” Integrated Vacation Retreat” Federal State Enterprise violated Part 1 Article 17 of the Federal Law “On Protection of Competition”.
