OREANDA-NEWS. May 03, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Office of the Federal Service for Veterinary and Phyto-Sanitary Supervision for the Khabarovsk Region, Jewish Autonomous Region and Sakhalin Region (Rostselkhoznadzor Office) for the signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

The case was initiated upon a petition of “Wood Export” Ltd. that the regional Office of Rostselkhoznadzor refused to issue a phyto-sanitary certificate for the products subject to quarantine on the grounds that the consignor had failed to submit information about the railcar numbers.

According to the Findings of the Supreme Arbitration Court, submitting information about railcar numbers in order to receive phyto-sanitary certificates is not required by the international conventions or the law of the Russian Federation.

FAS Russia believes that the requirement set by the regional Office of Rostselkhoznadzor to submit information about the railcar numbers in order to receive phyto-sanitary certificates unreasonably prevents activities of economic entities.

The case is scheduled for 12th May 2011.
