OREANDA-NEWS. April 01, 2011. Kemerovo Regional Arbitration Court dismissed the claim of “Shkola Okhrany 2000” Private Educational Institution on invalidating the decision of the Office of the Federal Antimonopoly Service in the Kemerovo region (Kemerovo OFAS Russia) that “Shkola Okhrany 2000” had violated the antimonopoly law, reported the press-centre of FAS Russia.

Earlier Kemerovo OFAS Russia found that “Interlock-N” Training Centre” and “Shkola Okhrany 2000” Private Educational Institutions violated Clause 1 Part 1 Article 11 of the Federal Law “On Protection of Competition”.

“Interlock-N” Training Centre” and “Shkola Okhrany 2000” violated the law by exercising concerted actions towards fixing and maintaining the same prices for the services of professional training and advancing qualification of security guards in Novokuznetsk.

Additionally, in course of a judicial investigation, representatives of these educational institutions openly confirmed the fact of cooperation between these institutions: fixing the price for their services, which became an additional evidence of informal price collusion and confirmed the rightness of the conclusions made by Kemerovo OFAS Russia.

Having considered all above circumstances, Kemerovo Regional Arbitration Court established that actions of “Shkola Okhrany 2000” Private Educational Institution constituted a violation of the antimonopoly law.

“The antimonopoly violation committed by educational institutions providing professional training of security guards was revealed upon the findings of an inspection carried out to fulfill instructions of FAS Russia. Lately, Kemerovo OFAS Russia has been more and more frequently identifying the signs of agreements or concerted actions between economic entities on the markets. This case serves as one of the example of the established antimonopoly practice, and is a small contribution of Kemerovo OFAS Russia to enforcement of No.272-FZ Federal Law “On Introducing Amendments to Certain Legislative Acts of the Russian Federation Due to Improving Government Control in the Field of Private Security and Detective Activities” of 22nd December”, said Deputy Head of the Office of the Federal Antimonopoly Service in the Kemerovo region, Ms. Elena Kloster.
