OREANDA-NEWS. March 29, 2011. Important questions and problems of enforcement of the Law “On State Regulation of Trading Activities in the Russian Federation” were discussed at a workshop in Kislovodsk, reported the press-centre of FAS Russia.

Representatives of regional offices of the Federal Antimonopoly Service (FAS Russia), Deputy Head of Stavropol Regional Committee for Food and Processing Industry, Trade and Licensing of the Stavropol region, a judge of the 16th Arbitration Appeal Court, etc., took part at the workshop.

In 2010 the antimonopoly bodies, following the instructions of the President and the Prime-Minister of the Russian Federation, begin monitoring enforcement of Articles 9, 13, 14 and 15 of the Law “On Trade”.

At the end of 2010 came into effect the Federal Law “On Introducing Amendments to the Code of the Russian Federation on Administrative Violations”, which establishes liability for violating the antimonopoly rules and requirements to trading activities. Since 31st December 2010, FAS Russia and its regional offices have been considering cases on administrative violations, liability for which is established by Articles 14.40 - 14.42 of the Code of the Russian Federation on Administrative Violations.

The Head of the FAS Russia’s Unit for Trade and Non-Production Services, Yekaterina Uryukina, said that the provisions of Article 13 of the Law “On Trade” constitute an integral part of the antimonopoly law, violating which is liable under Article 14.40 of the Code on Administrative Violations.

Violations of Article 9 of the Law “On Trade” are liable under Articles 14.41 and 14.42 of the Code on Administrative Violations.

The procedures and the periods for holding violators administratively liable under these Articles are established by Part 1 Article 4.5 of the Code on Administrative Violations. Cases on administrative violations, liability for which is established under Article 14.40 of the Code on Administrative Violations, shall be initiated when the decision of a Commission of an antimonopoly body, that establishes the fact of violating the antimonopoly law of the Russian Federation, comes into force”, emphasised Yekaterina Uryukina.
