OREANDA-NEWS. March 28, 2011. The Federal Arbitration Court of the Moscow District confirmed legitimacy of the fine imposed by the Federal Antimonopoly Service (FAS Russia) upon the “Market Council” Non-Commercial Partnership for failure to execute a determination issued by FAS Russia, reported the press-centre of FAS Russia.

The “Market Council” violated the law by demanding “Aleksinenergosbyt” Ltd. to pay a RUB 5,000,000 membership fee, which prevented entry of “Aleksinenergosbyt” Ltd. to the wholesale market of electric power and capacity.

The “Market Council” Non-Commercial Partnership disagreed with the FAS Russia’s determination and filed a lawsuit. Moscow Arbitration Court supported the position taken by FAS Russia. Later the 9th Arbitration Appeal Court reversed the judgment of the Court of First Instance.

However, the Federal Arbitration Court of the Moscow District pronounced legitimacy of the FAS Russia’s determination to impose the fine.
