OREANDA-NEWS. March 16, 2011. The Tyumen Office of the Federal Antimonopoly Service (OFAS Russia) fined “Tyumen Vodocanal” Ltd. 3,901,156 Rubles for abusing market dominance, reported the press-centre of FAS Russia.

Investigating an antimonopoly case, Tyumen OFAS Russia established that “Tyumen Vodocanal” Ltd. concluded a contract with “Indigo” PKF” Ltd. on connecting to water supply and sewerage networks, where it unlawfully fixed a connection fee. “Tyumen Vodocanal” Ltd. refused to satisfy the company’s request to exclude the condition about the connection fee from the contract, referring to the Rules for concluding and executing public contracts for connection to the systems of communal infrastructure.

Under the Rules, the connection fee shall not be charged if in order to connect a capital construction facility to water supply and sewerage networks there is no need to increase the network capacity. The conditions for connecting the capital construction facility to water supply and sewerage networks, issued to “Indigo” PKF” Ltd., did not include any measures for connecting the facility.

Having investigated the case, Tyumen OFAS Russia found that “Tyumen Vodocanal” Ltd. violated the antimonopoly law and imposed a fine upon the company in accord with the Code of the Russian Federation on Administrative Violations: for legal entities - from 1% o 15% of the company’s income on the market where the violation was committed.
