FAS: FGC UES Withdrew Its Claim
OREANDA-NEWS. March 05, 2011. Moscow Arbitration Court accepted “FGC UES” OJSC withdrawing its claim and stopped the proceedings on the case against the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.
On 6th August 2010, the FAS Russia’s Commission found that “FGC UES” OJSC violated Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”. The company attempted to force its counteragent “Tyumenenergo” OJSC to agree for disadvantageous and non-statutory conditions of additional agreements to No.121/ТP-М8 contract of 29th February 2008 about preliminary payment for technological connection; construction and design of electric power network facilities; and extending the period for implementing measures to provide technological connection.
In course of the case investigation “FGC UES” OJSC sent a new additional agreement to the contract on technological connection to “Tyumenenergo” OJSC, from which it excluded questionable conditions. On 3rd August 2010 the companies signed the additional agreement. In view of this FAS Russia stopped the proceedings on the case, qualifying actions undertaken by “FGC UES” OJSC as voluntary eliminating the antimonopoly violations.
