FAS Closed Case against Producers of Cathode Copper
OREANDA-NEWS. March 03, 2011. The Commission of the Federal Antimonopoly Service (FAS Russia) terminated the proceedings on the case against “UGMK-Holding” Ltd., “UGMK-OTsM” Ltd., “Uralelektromed” OJSC, “UGMK” Trading House” CJSC and”Sredneuralsky Copper Works” OJSC for violating Clauses 6 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
The case was initiated upon the findings of an analysis of the market of cathode copper in 2008-2009, as part of which FAS requested the market players to submit such information as their valid contracts and additional agreements to the contracts.
Having investigated the case, the FAS Russia’s Commission concluded that there were no signs of unreasonably fixing contract coefficients for supplies cathode copper to domestic and foreign consumers.

1. Clause 6 Part 1 Article 10 of the Federal Law “On Protection of Competition” prohibits economically, technologically or otherwise unjustified fixing different prices (tariffs) for the same goods, unless provided otherwise by the federal law.
2. Clause 8 Part 1 Article 10 of the Federal Law “On Protection of Competition” prohibits creating discriminatory conditions.
3. Clause 2 Part 1 Article 48 of the Federal Law “On Protection of Competition”provides for terminating the antimonopoly proceedings in the absence of the violations of the antimonopoly law in the actions (omissions) investigated by the FAS Russia’s Commission.
