Mykolayiv Commercial Sea Port to Pay UAH 300 000 Fine
OREANDA-NEWS. February 28, 2011. The Economic Court of Kyiv denied the claim of the State Enterprise “Mykolayiv Commercial Sea Port”and confirmed the legality of the decision of the Antimonopoly Committee of Ukraine dated 21.09.2010, which established the fact of abuse of monopoly in the port services market that are connected with administration of functions to ensure navigation safety, through actions that substantially restrict competitiveness of “NIBULON” on the national transshipment market, without objectively justified reasons.
Monopoly abuse is in baseless establishment in compulsory regulation through “Mykolayiv Commercial Sea Port”, approved by the Head of “Mykolayiv Sea Commercial Port” dated 01.06.2009 № 315 and published in the Official bulletin “Notices to mariners” (publication 3 dated 22.01.2010) restrictions limit of the length of cargo ships, up to 170 m, which are allowed for navigation along the first bend of the channel of water area of Mykolayiv port and to the berth of “NIBULON”.
According to this decision for abuse of monopoly the State Enterprise “Mykolayiv Commercial Sea Port” was fined to the amount of UAH 300 thousand.
