Russian Railways Lost Court Case to Ulyanovsk OFAS Russia
OREANDA-NEWS. February 08, 2011. The 11th Arbitration Appeal Court in Samara confirmed the decision of the Office of the Federal Antimonopoly Service in the Ulyanovsk region (Ulyanovsk OFAS Russia) that “Russian Railways” OJSC violated Clause 10 Part 1 Article 10 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
In course of a scheduled inspection, Ulyanovsk OFAS Russia discovered that “Russian Railways” OJSC violated the established pricing procedures providing additional services regulated under the Rules for applying charges for additional freight operations by federal railway transport. “Russian Railways” OJSC applied contract tariffs rates for the services for delivering and removing trains to railway tracks, for running general fleet of cars, etc.
“Russian Railways” OJSC filed a law suit challenging the decision of the antimonopoly body. However, Ulyanovsk Regional Arbitration Court and then the 11th Arbitration Appeal Court upheld the decision of Ulyanovsk OFAS.
“Not only “Russian Railways” OJSC violated the antimonopoly law but also infringed the interests those who received the services for delivering trains and containers for loading or unloading at railway stations”, said the Head of a Department of Ulyanovsk OFAS Russia, Ms. Marina Stepanova.
