Molnia Clock Plant Unreasonably Evaded Supplying Spare Parts
OREANDA-NEWS. December 20, 2010. The Commission of Chelyabinsk OFAS Russia found that “Molnia” Chelyabinsk Clock Plant” OJSC violated the Law “On Protection of Competition”. The company evaded entering into a contract with “356 Aviation Repair Plant” OJSC (of Engels) and supplying spare parts necessary to repair AChS-1 and AChS-1M aviation clocks, reported the press-centre of FAS Russia.
“356 Aviation Repair Plant” OJSC filed a complaint about “Molnia” Chelyabinsk Clock Plant” OJSC after numerous attempts to enter into a contract with the clock plant for supplying spare parts to repair aviation clocks.
During several years, “356 Aviation Repair Plant” OJSC was given refusals by “Molnia” Chelyabinsk Clock Plant” OJSC with various explanations.
“356 Aviation Repair Plant” OJSC carries out priority works (services) under government defence contracts and for aviation equipment repair for the needs of the Russian Ministry of Defence, and maintains mobilization capacities of the aviation equipment used by the Ministry of Defence: repair of helicopters and their units.
The repair plant has the necessary licenses and certificates to repair aviation clocks.
In support of its position “Molnia” Chelyabinsk Clock Plant” OJSC claimed that the aviation plant did not have a licence for repair of military equipment and “Molnia” is not involved in sales of spare parts to aviation clocks. Also the clock plant stated that it itself was able to repair the clocks.
“Molnia” Chelyabinsk Clock Plant” OJSC has dominant position on the market of production of finished clocks and other time instruments in the part of production of AChS-1 and AChS-1M aviation clocks, on the market of production of clockwork mechanisms, their parts and time instruments in the part of production of spare parts to AChS-1 and AChS-1M aviation clocks, and on the wholesale market of other consumer goods, not included in other groupings, in the part of supplies of AChS-1 and AChS-1M aviation clocks and spare parts to them in the Russian Federation.
“As “Molnia” Chelyabinsk Clock Plant” OJSC is the only producer and supplier of aviation clocks, “356 Aviation Repair Plant” OJSC was not able to buy spare parts from other economic entities to repair aviation clocks”, says Anna Kozlova, the Head of Chelyabinsk OFAS Russia.
According to a representative of “356 Aviation Repair Plant” OJSC, Vladimir Koulikov, the company has practically exhausted its stock of spare parts and does not have new supplies to timely complete the orders.
Having investigated the case, initiated on 22nd March 2010, Chelyabinsk OFAS Russia found that “Molnia” Chelyabinsk Clock Plant” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition” and issued a determination to stop the antimonopoly violation. OFAS Russia is going to initiate administrative proceedings against the violator.
