OREANDA-NEWS. December 09, 2010. Moscow Arbitration Court terminated the proceedings on the case of “Gazprom Neft” OJSC challenging the decision and determination of the Federal Antimonopoly Service (FAS Russia) that the company had abused market dominance on the wholesale markets of oil products, reported the press-centre of FAS Russia.

Earlier FAS Russia found that in Q1 2007 and in the first six months of 2008 “Gazprom Neft” OJSC fixed monopolistically high prices for petrol, diesel fuel, aviation kerosene and fuel oil, fixed different prices for the same goods without economic, technological or other justifications, and created discriminatory conditions for buyers on the wholesale markets of motor petrol, diesel fuel, aviation kerosene and fuel oil in the Russian Federation. FAS Russia issued a determination to the company to stop the violations and fined “Gazprom Neft” OJSC 1.356 billion Rubles.

“Gazprom Neft” OJSC disagreed with the decision of the antimonopoly authority and filed a lawsuit.

However, at the court hearing in Moscow Arbitration Court on 7th December 2010, “Gazprom Neft” OJSC withdrew its claim on invalidating the FAS Russia’s decision and determination, on the basis of which the company had been fined 1.356 billion Rubles for abusing market dominance on the wholesale markets of oil products.

The Court accepted the company’s withdrawing its claim. FAS Russia will enforce the determination upon coming into effect.
