OREANDA-NEWS. December 09, 2010. The Federal Antimonopoly Service (FAS Russia) found that “Rexam Beverage Can Naro-Fominsk” Ltd. and “Baltika” Breweries” OJSC engaged in anticompetitive agreement (in violation of Part 2 Article 11 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.

“Rexam Beverage Can Naro-Fominsk” Ltd. and “Baltika” Breweries” OJSC violated the antimonopoly law by concluding the agreement in 2006 to determine general conditions for circulation of 1.0-liter aluminum cans.

The agreement between “Rexam Beverage Can Naro-Fominsk” Ltd. and “Baltika” Breweries” OJSC restricted possibilities of other beer producers to sell their products in 1.0-liter aluminum cans. Therefore, the agreement restricted the choice of consumers buying beer in 1.0-liter aluminum cans.

Part 2 Article 11 of the Federal Law “On Protection of Competition” prohibits other agreements between economic entities or other concerted actions of economic entities if such agreements or concerted actions lead or can lead to restriction of competition, except “vertical agreements” that are allowed under Article 12 of the Federal Law “On Protection of Competition”.
