FAS Will Consider Case against Raduga Ltd & Sluzhba Dvizhenia Ltd
OREANDA-NEWS. On 12th November 2010, the Primorie Office of the Federal Antimonopoly Service (OFAS Russia) will consider a case against “Raduga” Ltd. and “Sluzhba Dvizhenia” Ltd., initiated upon the signs of violating Part 1 Article 11 of the Federal Law “On Protection of Competition” (concerted actions), reported the press-centre of FAS Russia.
“Raduga” Ltd. inspects technical conditions of vehicles в Bolshoi Kamen.
To pass state technical inspection, a vehicle owner must pay a state fee = 300 Rubles and also pay for inspection of technical condition of the vehicle (a car - 450 Rubles).Therefore, for a car owner the cost of state technical examination is around 750 Rubles.
At the same time, “Sluzhba Dvizhenia” Ltd. submitted 139 contracts for consulting services in course of technical inspection in August-September 2010. According to the contracts, the cost of such services was around 4,200 Rubles on top of state fee and the fee for inspecting technical conditions.
The companies stated that they had not had any contract relations. However, “Raduga” Ltd. submitted the list of the vehicle owners who had technical inspections in August-September 2010. According to this list, technical inspection must also be completed by car owners that concluded contracts for consulting services in course of technical inspection in “Sluzhba Dvizhenia” Ltd. Thus, to have technical inspections in “Raduga” Ltd. some car owners had to conclude contracts with “Sluzhba Dvizhenia” Ltd. That has no connection with state vehicle inspection.
The Director of “Raduga” Ltd. was employed as the Director and founder of “Sluzhba Dvizhenia” Ltd.
According to Primorie OFAS Russia, concerted actions of “Raduga” Ltd. and “Sluzhba Dvizhenia” Ltd. forced some car owners to pay an extra fee of 4,200 Rubles, not provided for by the law, for technical inspections of their vehicles.
“It’s a big sum and we must figure out what are the legal grounds for charging this amount”, said the Head of Primorie OFAS Russia, Mr. Sergey Vyalykh.
