FAS Wants to Introduce Fast-Track Procedures in Construction
OREANDA-NEWS. October 26, 2010. The Federal Antimonopoly Service (FAS Russia) proposes to introduce fast-track procedures for administrative disputes in construction, said the Head of FAS Russia Igor Artemyev in his video-address to the II annual conference “Antimonopoly Regulation in Russia”, organized by the “Vedomosti” newspaper and “Promoting Competition” Non-Commercial Partnership with support of the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.
“It is necessary in order to stimulate investment activities in Russia”, thinks Igor Artemyev.
“The authorities are the most serious violators of the antimonopoly law, often preventing normal development of business. We propose to introduce administrative dispute procedures in construction similar to the procedures under the law on state procurement: if an official refused to issue licenses and permits or delayed issuing such documentation, an entrepreneur will be able to lodge a complaint about such actions or omissions by government officials to FAS Russia. The period for complaint consideration shall not exceed ten days. Entrepreneurs also will have a possibility to lodge a complaint against actions of the officials to a court of law but this procedure will be more time-consuming”, - says Igor Artemyev.
If the procedures for issuing permits and licenses are violated, the responsible officials shall be fined. FAS Russia proposes that the fines should be similar to those imposed under the Code on Administrative Violations upon officials who violated the law on state procurement.
At the moment the proposals are being considered by the Government of the Russian Federation.
