OREANDA-NEWS. September 22, 2010. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Health Care and Social Development of the Russian Federation for the signs of violating Clause 1 Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

FAS Russia suspects that the Ministry violated the antimonopoly law by issuing No.665 Order “On approving the List of medications dispensed on a doctor’s (physician assistant’s) prescription when providing additional free medical assistance to certain categories of citizens entitled to state social care” of 18th September 2006. According to the Order, the List of medications under international non-proprietary names for pharmaceutical substances specifies producers of pharmaceutical substances, which restricts competition on the relevant pharmaceutical markets.

The case is scheduled for 21st October 2010.

Clause 1 Part 1 Article 15 of the Federal Law “On Protection of Competition” prohibits federal executive bodies, the authorities of the constituent territories of the Russian Federation, local self-government bodies and other bodies and organizations exercising the functions of the above bodies, as well as state extra-budgetary funds and the Central Bank of the Russian Federation to pass acts and (or) exercise other actions (omissions) that lead or can lead to preventing, restricting or eliminating competition, except when passing such acts and (or) exercising such actions (omissions) is provided for by federal laws, and prohibits to introduce restrictions for founding economic entities in any field of activity, and banning or putting restrictions for some types of activity or production of some goods.
