FAS Initiated Case against Social Security Fund of RF
OREANDA-NEWS. September 16, 2010. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Social Security Fund of the Russian Federation upon discovering the elements of violating of the antimonopoly law. Contrary to the Law, the Fund approved mandatory requirements for the bidders wishing to take part in an auction for supplies of computer equipment, according to which PC should have only Intel microprocessors, reported the press-centre of FAS Russia.
The case was initiated upon the signs of violating Part 2 Article 17 of the Federal Law “On Protection of Competition” (which prohibits restricting participation in competitive bidding). According to FAS Russia, the Fund’s actions could have restricted participation in the auction for suppliers of personal desktop computers with motherboards that have chipsets compatible with AMD processors.
Under Part 2 Article 17 of the Federal Law “On Protection of Competition”, if tender or auction organizers or ordering parties are federal executive bodies, executive bodies of the constituent territories of the Russian Federation, local self-government bodies, state extra-budgetary funds, as well as if tenders and auctions are organized to award contracts for goods, works or services for state or municipal needs, any restrictions of participation in the auctions or tenders, which are not provided for by federal laws or any other normative legal acts, are prohibited.
