Court: MOEK Imposed Disadvantageous Conditions of Heat Supply Contract
OREANDA-NEWS. August 06, 2010. The Federal Arbitration Court of the Moscow District pronounced legitimacy of the decision of the Moscow Office of the Federal Antimonopoly Service (the Moscow OFAS Russia) regarding "MOEK" OJSC. OFAS found that the company was imposing a heat supply contract with disadvantageous conditions upon "Gourzuf" Housing Association (a residential house on Warshavskoye Highway, Moscow). The Court of the First Instance and the Appeal Court arrived to similar conclusions, reported the press-centre of FAS Russia.
The Commission of the Moscow OFAS Russia established that "MOEK" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (prohibiting abuse of market dominance). The company infringed the interests of "Gourzuf" Housing Association by imposing the heating supply contract with disadvantageous conditions. OFAS issued a determination to "MOEK" OJSC to eliminate the violations.
"We'll get further actions of "MOEK" OJSC" under control", commented the ruling Vladimir Yefimov, the Head of the Moscow OFAS Russia. "Issuing decision and determination regarding the company, we were certain that they were correct. Now the Court has confirmed that our actions are justified. Accordingly, the determination issued by the antimonopoly body will be executed, which will restore the rights of the citizens - members of the Housing Association".
