Gazpromneft-Omsk Paid 60 mln Rubles as Fine
OREANDA-NEWS. May 25, 2010. The Office of the Federal Antimonopoly Service in the Omsk region (the Omsk OFAS Russia) has been informed that "Gazpromneft'Omsk" OJSC paid the fine for violating the antimonopoly law on the market of oil products in the Omsk region. The amount of fine is more than 60 million Rubles, reported the press-centre of FAS Russia.
In February 2009, the Omsk OFAS Russia found "Gazpromneft'Omsk" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition". The company fixed economically and technologically unjustified retail prices for oil products in 2007and January - September 2008 on retail markets of motor petrol and diesel fuel in the Omsk region.
"Gazpromneft'Omsk" OJSC transferred the funds to the federal budget when the Courts of three instances had confirmed legitimacy of the actions undertaken by the antimonopoly body.
Today "Gazpromneft'Omsk" OJSC is challenging the decision and determination issued by the Omsk OFAS Russia on the second case. The Court of First Instance and the Appeal Court already confirmed validity and justness of the decision made by the antimonopoly body.
On antimonopoly cases initiated again oil companies in various regions throughout Russia in 2008-2009, around 50 decisions of the antimonopoly bodies have taken legal effect. In about 60 cases judicial proceedings have not been over yet.
The total amount of fines transferred by the oil companies to the budget following the litigations is more than 300 million Rubles.
In May 2010, the Cassation Courts pronounced legitimacy of the decisions taken by the antimonopoly bodies regarding "LUKOIL-Permnefteproduct" Ltd. for violating the law on competition in the Perm region and "LUKOIL-Uralnefteproduct" OJSC - for violations in the Tyumen region.
