OREANDA-NEWS. May 12, 2010. The Ostankinsky district court of Moscow condemned V.I. Kemaykin, born in 1982, recognizing him guilty of the crime specified in para “b” Part 3 Art. 165 of the Criminal Code of the Russian Federation.

V.I. Kemaykin has worked in Ingosstrakh OJSIC as an insurance agent since 2006. He entered into motor hull insurance contracts, but instead of transferring the cash (insurance premium) paid by the clients to the insurance company’s cash office, in accordance with the agency agreement, he pocketed it. The fraud was discovered when one of these clients went to Ingosstrakh’s office, where it turned out that his insurance police had not been paid. Overall, Kemaykin stole from the company 1,280,323 rubles 03 kopecks.

When the theft of cash was discovered, an agreement for voluntary damage refund was signed between Ingosstrakh OJSIC and V.I. Kemaykin; however, the ex-agent refunded to the company only 75,000 rubles. For this reason, Ingosstrakh’s security service contacted the police and filed a complaint for fraud.

The company’s management resolved to deem valid all the motor insurance contracts issued and renewed by Kemaykin. All clients who requested indemnity to the insurer were indemnified. Similar cases in the company happened before; therefore Ingosstrakh OJSIC indemnifies all clients who have a confirmation of insurance policy payment. In this way, the material damage caused by the defrauder to the company did not affect the clients.

The court recognized V.I. Kemaykin guilty and condemned him to imprisonment for two years. The sentence is suspended with a two-year period of probation. During the court session Ingosstrakh OJSIC’s civil claim for collection from V.I. Kemaykin of cash in the amount of 1,205,323 rubles 03 kopecks was sustained.
