OREANDA-NEWS. May 07, 2010. The Office of the Federal Antimonopoly Service in the Yaroslavl region (the Yaroslavl OFAS Russia) fined "Yargorelektroset" Municipal Unitary Enterprise 3,525,490 Rubles for abusing market dominance on the market for electric energy transmission. The "turnover" fine is 1% of income gained by the enterprise in the past year on the relevant market, reported the press-centre of FAS Russia.          

Earlier the Yaroslavl OFAS Russia found that "Yargorelektroset" Municipal Unitary Enterprise violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (which prohibits abusing market dominance). The Court of First Instance and the Appeal Court confirmed validity of this decision.

"Yargorelektroset" violated the law by incorrectly calculating the payment for increasing capacity to 92 kW for energy supply and further operation of a store in Yaroslavl.

Instead of the current capacity at 53.5 kW, "Yargorelektroset" Municipal Unitary Enterprise used a wrong value for calculations - 42.8 kW, which increased the difference between the current capacity and the applied capacity by approximately 10 kW. As 1 kW costs around 9000 Rubles, such actions of "Yargorelektroset" Municipal Unitary Enterprise could have infringed the interests of the store owner and caused unreasonable financial expenses.

The Commission issued a determination to the violator to take 53.5 kW as the current capacity value.
