OREANDA-NEWS. March 12, 2010. The Government of the Russian Federation adopted No.129 Resolution "On Agreements between the Executive Bodies, Local Self-Government Bodies and Economic Entities about Reducing or Maintaining Prices for Some Types of Fuel and Lubrication Materials, Being Sold by Agricultural Goods Producers". The draft Resolution was devised by the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.

The main objective of the Resolution is to regulate legal relations in fuel supplies for agricultural works in 2009 and 2010.

The draft Resolution provides for the measures aimed at ensuring transparency of supplies of fuel and lubrication materials for agricultural producers at reduced prices, equal access of participants of the market of agricultural production to supplies of fuel and lubrication materials at reduced prices, and intended use of supplied fuel and lubrication materials.

The document was formulated by FAS Russia in accordance with Clause 1 Article 16 and Part 2 Article 13 of the Federal Law "On Protection of Competition". Under the Law, the Government of the Russian Federation can issue normative acts specifying acceptable agreements between state bodies of the constituent territories of the Russian Federation, local self-government bodies and economic entities, as well as between economic entities about reducing or maintaining prices (rates) for some types of goods.

The Resolution formalizes the practice of concluding agreements for up to 10% discount offered by oil complies for fuel and lubrication materials supplied to agricultural producers, which was emerging in 2009. The Resolution is valid for legal relations developed since 1st March 2009. Duration of such agreements can be until 31st December 2010.

Currently FAS Russia is masterminding legal mechanisms that will enable transition to market support measures for agricultural producers in 2011 with regard to supplied of fuel and lubrication materials.
