OREANDA-NEWS. February 25, 2010. Last week the Federal Antimonopoly Service (FAS Russia) considered a case against "Doctor Web" Ltd. For the hearing the company presented documents confirming that it had eliminated the elements of antimonopoly violations, reported the press-centre of FAS Russia.

On 28th October 2009, FAS Russia initiated a case against "Doctor Web" Ltd. the signs of violating Part 3 Article 11 of the Federal Law "On Protection of Competition". FAS Russia suspected that the company violated the law by not performing product supplies to official suppliers if they breach the company's pricing policy.

Such difficulties were experienced by the petitioner, upon whose complaint FAS Russia opened the case. For instance, the petitioner claimed that after it had proposed the price below the "recommended price" at the quotation request for supplies of antivirus software for the state needs, and had been awarded the government contract, the petitioner had been unable to honour its obligations because "Doctor Web" Ltd. had blocked product supplies on the grounds of breaching the company's policy.

Failure to execute contract obligations can lead to including bidders in the Register of Unfair Suppliers, which means that for two years the company cannot take part in state and municipal procurement in the Russian Federation.

In course of the case investigation, however, "Doctor Web" Ltd. presented information about hard facts of downward deviation against the recommended price by the bidders for the government contracts. Documents show that in such instances "Doctor Web" Ltd. did not refuse to supply products to the winners.

"Doctor Web" Ltd. also presented documents confirming that the producer of antivirus software introduced changes to its licensing agreements and supply contracts with the company's counteragents. In particular, the documents now contain the term of a "recommended price" for the end-users. A similar term is now included in the company's price-lists.

FAS Russia emphasizes that these changes encourage competition among the authorized suppliers and distributors of the company's products, as they clarify the nature of relationships between them.

The proceedings against "Doctor Web" Ltd. are terminated.
