OREANDA-NEWS. February 15, 2010. The Federal Antimonopoly Service (FAS Russia) closed a case against the Moscow City Property Department due to absence of violations of the antimonopoly legislation. The case was initiated for elements of violating Part 1 Article 15 of the Federal Law "On Protection of Competition" (the Moscow City Property Department evaded providing state support in the form of fixing a preferential rent rate). The Moscow Government will receive a letter with recommendations about ensuring transparency of the procedures for obtaining state support by companies, reported the press-centre of FAS Russia.

FAS Russia suspected that actions of the Moscow City Property Department had certain signs of preventing a small company - "Lodi" Ltd. - from exercising its right for state support because the Department failed to fix a preferential rent rate.

Investigating the case, FAS Russia concluded that the Moscow City Property Department had not violated the antimonopoly law. The facts, indicating that the Moscow City Property Department evaded providing state support, were not confirmed.

At the same time FAS Russia has established that persons, claiming state support in the form of a preferential rent rate, do not have direct access to the description of the procedure for providing state support and refusal conditions. FAS Russia has made a decision to forward the relevant recommendation to the Moscow Government.
