Gazprom Neft Wins Court of Appellate Jurisdiction Cancelling FAS Fine
OREANDA-NEWS. February 10, 2010. During the court session held on February 2, the Thirteenth Arbitration Appeal Court upheld the first judgment cancelling the FAS (Federal Antimonopoly Service) fine in respect of Gazprom Neft in the amount of 4.7 bln. rubles. Gazprom Neft is satisfied with the fact that the court heeded the arguments of the lawyers and took the Company’s side.
In August 2009, FAS sized up the fine in the amount of 4.7 bln. rubles to be paid by Gazprom Neft for antitrust offense in respect of abuse of dominance in the oil products wholesale market in the first half of 2009.
Further, in November the Company won an action in the court of trial: the Arbitration Court of St. Petersburg and the Leningrad Region invalidated the acts issued by Federal Antimonopoly Service against Gazprom Neft in respect of the charge brought against the Company for abuse of dominance in the oil products wholesale market in the first half of 2009 and a fine enactment in the amount of 4.675 bln. rubles, whereat FAS filed an appeal.
