OREANDA-NEWS. December 23, 2009. The 16th Arbitration Appeal Court confirmed validity of the decision and determination issued by the Office of the Federal Antimonopoly Service in the Republic of Dagestan (the Dagestan OFAS Russia) regarding "Kavkazregiongaz" Ltd. Earlier the Appeal Court also supported the conclusions made by the antimonopoly body, reported the press-centre of FAS Russia.

The Dagestan OFAS Russia found that "Kavkazregiongaz" Ltd. violated Article 10 of the Federal Law "On Protection of Competition" (which prohibits abusing dominant position) by imposing unfavourable contract conditions upon gas consumers.

The case was initiated upon complaints from gas consumers about the re-evaluation requirements for gas metering units regardless of their service date.

Emphasizing the importance of this court ruling, the Head of the Dagestan OFAS Russia Kurban Kubasaev drew attention to inadmissibility of such actions by gas suppliers as well as to prevention and constraints of imposing similar unfavourable conditions upon consumers.
