OREANDA-NEWS. December 17, 2009. When presenting the draft document the chairman of the Parliamentary Agricultural Policy Committee, Eldar Ibrahimov, said that in the process of preparing the Bill for the 2nd reading it was made 250 amendments. The draft was also added 11 new articles and withdrawn 3 articles.

“In particular, now the bill specifies procedure of definition of state needs when conveying lands, introduces practice of court solution of disputes if the parties fail to reach agreement on repurchase of lands, and defines a mechanism of definition of market cost when repurchasing lands,” Ibrahimov said.

The price will be fixed as average level for the last 90 days on the basis of data on registration of real estate deals in notarial office. Compensation for conveyed land can be paid in money property or other form.

MP Gudrat Hasanguliyev, however, pointed out that notarial office’s data could be wrong as when registering deals through a notarial office the parties, as a rule, underestimate value of land 5 or 6 fold. Instead he suggested establishment of special commissions to evaluate lands conveyed in favor of the government.

“The law concerns only land, but not any other property that can be located on the land plot,” Ibrahimov says.

At the same time the government can help the landlord in transfer of its property. MP Aynur Guliyeva offered to include in the draft law a mechanism of such aid and its clearer description. Guliyeva also proposed to indicate in the draft law the regime of sanctions for court’s dragging out of the consideration of complaints during cession of lands in favor of the government in order to avoid “classic fraudulence”.

Today the bill allow acquisition of lands for highways of state significance, oil and gas pipelines, sewage lines, electric transmission lines, hydro-technical facilities, border security lines, facilities of defence and state security, mining facilities of state importance. MPs also offered to widen the list in particular by water pipelines and flow passages.
