FAS Initiated Cases against Domodedovo Authority & Vodokanal
OREANDA-NEWS. December 10, 2009. The Federal Antimonopoly Service (FAS Russia) initiated antimonopoly proceedings against the authority of the Domodedovo Town District, the Moscow Region (the Domodedovo Town Authority) for adopting some acts and also lack of actions that can lead to preventing economic activities of a developing company, reported the press-centre of FAS Russia.
FAS Russia also initiated a case against "Domodedovsky Vodokanal" Municipal Unitary Enterprise of the Domodedovo Town District ("Domodedovsky Vodokanal" MUP) for imposing unfavorable contract conditions upon a counteragent or conditions irrelevant to the subject of the contract, applying different pricing procedures for connecting capital facilities to public utility infrastructure systems, and for violating the established pricing procedures.
Cases were initiated upon a petition of "Druzhba" Group of Companies" CJSC - a developing organization building residential housing in Domodedovo.
Complying with technical specifications, from October 2007 the developer has been unable to complete construction of the water line, which will supply drinking water to the residential houses under construction in "Druzhba" neighbourhood. The Domodedovo Town Authority leased out a plot of land, required for construction of the water line, to another construction organization without encumbrance. Repeated developer's enquiries to the Domodedovo Town Authority were to no avail.
FAS Russia believes that the acts adopted by the Domodedovo Town Authority to lease a plot of land without encumbrance, and further lack of actions of the Domodedovo Town Authority on the issue, have the signs of violating Article 15 of the Federal Law "On Protection of Competition".
Investigating the documents presented by the parties, FAS Russia discovered that apart from encumbrances for constructing the water line as indicated in the technical specifications, "Domodedovsky Vodokanal" MUP proposed that Druzhba" Group of Companies" CJSC should sign contracts for connection to the water supply and water drainage systems at additional charge. Moreover, connection charges are calculated differently for different developers.
As "Domodedovsky Vodokanal" MUP dominates the market for water supply and drainage services within the boundaries of the Domodedovo Town District, the Moscow Region, FAS Russia believes that actions of "Domodedovsky Vodokanal" MUP have the signs of violating Article 10 of the Federal Law "On Protection of Competition".
Cases will be heard on 15th December 2009.
