OREANDA-NEWS. October 14, 2009. The Office of the Federal Antimonopoly Service in the Yaroslavl Region (OFAS Russia) initiated proceedings against "Yatoslavsky Zavod Toplivnoi Apparatury [Yaroslavl Fuel Equipment Works]" OJSC ("YaZTA" OJSC) for the elements of violating Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position). The Yaroslavl OFAS Russia sees the elements of violation by "YaZTA" OJSC transferring heat energy to a branch of "RZhD OJSC - "Severnaya Zheleznaya Doroga [North Railway]" without using the tariffs set by the authorised body, reported the press-centre of FAS Russia.

The case was initiated upon a petition of a branch of "RZhD OJSC - "Severnaya North Railway". The Petitioner stated that "YaZTA" OJSC had threatened the Works that it would cut off heat supply to the building of centralisation post and compression mechanical-unit at "Yaroslavl Glavny" station. The station is involved in the railway operations; it has control and service personnel, and automated systems enabling operation of a cargo railway station. In course of the investigation, "YaZTA" OJSC voluntary eliminated the violation before the antimonopoly case was initiated.

Inspection by The Yaroslavl OFAS Russia found the elements of violating pricing procedures by "YaZTA" OJSC when transferring heat energy to the North Railway.

The case will be heard on 11th November 2009.
