OREANDA-NEWS. October 08, 2009. The Federal Antimonopoly Service (FAS Russia) found that "Podolskaya Elektroset" Municipal Unitary Enterprise and "Impuls" Ltd. breached Clause 5 Part 1 Article 11 of the Federal Law "On Protection of Competition". In course of the case investigation the companies voluntarily eliminated the violations, and presented appropriate evidence to FAS Russia, that terminated the proceedings, reported the press-centre of FAS Russia.

Clause 5 Part 1 Article 11 of the Federal Law "On Protection of Competition" prohibits agreements between economic entities or concerted actions of economic entities in the goods market if such agreements or concerted actions have resulted or can result in imposing contract conditions unfavourable to the counteragent or irrelevant to the subject matter of the contract.

FAS Russia established that issuing determination about installment (replacement) of electric power meters, "Podolskaya Elektroset" Municipal Unitary Enterprise imposed "Impuls" Ltd. as the executor of the works.

In course of the case investigation the companies voluntarily eliminated the violations. In particular, "Podolskaya Elektroset" Municipal Unitary Enterprise devised a new form of determinations and stopped indicating specific construction-and-assembling organisations, which must carry out the works for installing electric power meters.

FAS Russia will see at initiating an administrative case.

On 23rd July 2009, FAS Russia pronounced that "Podolskaya Elektroset" Municipal Unitary Enterprise violated Part 1 Article 10 of the Federal Law "On Protection of Competition".

Having dominant position in the market of electric power transmission, "Podolskaya Elektroset" Municipal Unitary Enterprise infringed the interests of residents and organisations providing technological connection to electric networks уwithin the boundaries of its own networks. The company charged additional fees on top of the standard fee in the form of agency remuneration, and fixed requirements in technical specifications that were not provided for by the current legislation. Also "Podolskaya Elektroset" introduced restrictions for the use of electric power.
