Court Confirmed that Companies Have to Pay for Anticompetitive Actions
OREANDA-NEWS. October 05, 2009. The Arbitration Court of the Moscow District dismissed the claim of "Voskresenskie Mineralnie Udobrenia [Voskresensk Fertilizers]" OJSC for invalidating the fines imposed by the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.
FAS Russia fined "Voskresenskie Mineralnie Udobrenia" OJSC 1.5 million Rubles for abusing dominant position on the market of sulphate-free phosphoric acid.
Derivatives of sulphate-free phosphoric acid are also used in car-making and food industry.
"Voskresenskie Mineralnie Udobrenia" OJSC refused to supply sulphate-free phosphoric acid to "Voskresensky NIUiF" OJSC without any economic of technological reasons, created discriminatory conditions and infringed economic interests of "Voskresensky NIUiF" OJSC in 2008.
FAS Russia found that "Voskresenskie Mineralnie Udobrenia" OJSC violated Article 10 of the Federal Law "On Protection of Competition" because the arguments raised by the company did not justify terminating the supplies.
"The company's actions could have adverse consequences not only for the market of sulphate-free phosphoric acid, by for the chemical industry in general", said Teimuraz Kharitonashvili, the Head of the Department for Control over the Chemical Industry and the Agro-Industrial Complex.
In the first six months of 2009FAS Russia and its regional offices initiated 4168 cases on violating the Federal Law "On Protection of Competition", of which 4603 for abusing dominant position.
