OREANDA-NEWS. October 01, 2009. The Office of the Federal Antimonopoly Service in the Yaroslavl region (OFAS Russia) fined "Yaroslavl Tire Plant" OJSC ("YaShZ" OJSC) for abusing its dominant position on the market of electric and heat energy, reported the press-centre of FAS Russia.

The case was initiated after the Antimonopoly Service inspected whether "Yaroslavl Tire Plant" OJSC complied with the antimonopoly legislation.

The Yaroslavl OFAS Russia established that "YaShZ" OJSC charged "Yaroslavl Plant of Industrial Rubber Products" OJSC a fee for transmitting electric and heat energy according to the rates set by the Director on Finances and Economic Affairs of "YaShZ" OJSC without reference to the Yaroslavl Regional Department of Fuel, Energy Production and Tariff Regulation.

The actions of "Yaroslavl Tire Plant" OJSC violated Clause 10 Part 1 Article 10 of the Federal Law "On Protection of Competition".

The Law forbids actions (lack of actions) of an economic entity that has dominant market position, which have resulted or can result in preventing, restricting or eliminating competition and (or) infringing the interests of other persons, particularly violating the pricing procedures established by normative legal acts.

"Yaroslavl Tire Plant" OJSC was fined 5,964,558.34 Rubles under Article 14.31 of the Code of the Russian Federation on Administrative Violations.
