OREANDA-NEWS. September 25, 2009. The Moscow Arbitration Court dismissed the claim of "Znamya" Moscow Machine-Building Plant" CJSC on invalidating and abolishing the determination of the Federal Antimonopoly Service (FAS Russia), reported the press-centre of FAS Russia.

"Znamya" Moscow Machine-Building Plant" CJSC is involved in manufacturing components to military and civil aviation equipment.

Breaching Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition", "Znamya" Moscow Machine-Building Plant" CJSC avoided signing a contract for supplies of components for hydraulic helicopter systems with "256 ARZ" OJSC without any economic or technological justification.

FAS Russia issued a determination to "Znamya" Moscow Machine-Building Plant" CJSC to eliminate antimonopoly violations by entering into the contract for supplying components necessary to repair "Мi" helicopters with "256 ARZ" OJSC.

Within the statutory period, "Znamya" Moscow Machine-Building Plant" CJSC filed documents to FAS Russia to confirm execution of the above determination.

Under Article 14.31 of the Code on Administrative Violations (CoAV), FAS Russia fined "Znamya" Moscow Machine-Building Plant" CJSC 1,185,390 Rubles for abusing dominant position on the market of aviation equipment.

"Znamya" Moscow Machine-Building Plant" CJSC disagreed with the decision of the antimonopoly body and appealed it. The Court, however, confirmed validity of the FAS Russia's actions.
