OREANDA-NEWS. September 24, 2009. Victor Saribekyan, Head of the Tax and Legal Consulting Practice, the Energy Consulting Group, PhD in Economics, submitted his report in a workshop ‘New regulations between taxpayers and tax & law enforcement agencies’. This event was arranged by JSCB INVESTTRADEBANK and by Еnergy Consulting Company within the framework of the International Bank Club ‘Analytics without limitations’. The meeting brought together over 60 representatives of commercial banks, large, small and medium-sized businesses, reported the press-centre of Energy Consulting.

The workshop focused on the last amendments in the first part of the Russian Tax Code as follows: out-of-court procedure for the settlement of tax disputes, desk tax audits, tax reports review, as well as amendments in Law on Militia in part of control over business activities.

Key changes in relations between taxpayers and tax agencies are based on promulgation of the mandatory out-of-court procedure for the settlement of tax disputes. The speaker shared his views on the enforcement of this procedure in practice by Arbitrary Courts, remarked its benefits and implications.

Changes in relations between taxpayers and law enforcement agencies are based on the matter the last ones forfeit their out-of-court rights with respect to taxpayers. These rights, enlisted earlier in Law on Militia, have been revoked. In fact, due to such amendments the law enforcement agencies have deprived of their rights to check taxpayers until instituting criminal proceedings. The attendees paid special attention to the ways how the law enforcement agencies could overcome such the limitations of their rights. At the end of the meeting the participants shaped their recommendations on protection of taxpayers’ interests.
