FAS Found Kaspersky Laboratory Violated Law
OREANDA-NEWS. September 15, 2009. The Office of the Federal Antimonopoly Service in the Chelyabinsk region (the Chelyabinsk OFAS Russia) found that "Kaspersky Laboratory" CJSC violated Part 3 Article 11 of the Federal Law "On Protection of Competition" (which prohibits competition-restricting coordination of economic activities between market participants), reported the press-centre of FAS Russia.
The Programme for distributing antivirus products included a clause on selling antivirus products by suppliers at the prices recommended by "Kaspersky Laboratory". A literal interpretation of the clause suggests that the companies distributing the products did not have a possibility to independently set their prices.
However, "Kaspersky Laboratory" presented documentation to the OFAS Russia's Commission confirming voluntary elimination of the antimonopoly violations by amending the Programme for distributing antivirus products.
According to the new Programme conditions, the prices included in the price-list are recommended prices.
In view of the above, the Chelyabinsk OFAS Russia did not issue a determination.
If for the next quotation request the authorizes suppliers of "Kaspersky Laboratory" again offer similar prices it can be interpreted as a sign of collusion and can constitute the grounds for initiating antimonopoly proceedings.
