OREANDA-NEWS. July 20, 2009. The Federal Antimonopoly Service (FAS Russia) initiated an antimonopoly case against "Energoatom" Concern" OJSC and "Khimmash" Group of Machine-Building Plants" CJSC. The case was initiated upon a petition of "ENEKO- center" Ltd., reported the press-centre of FAS Russia.

On 28th November 2008, "Energoatom" Concern" OJSC and "Khimmash" Group of Machine-Building Plants" CJSC concluded a contract for the works for manufacturing and supplying equipment (air conditioners) for No.4 power block of Beloyarsk Nuclear Power Station. The contract was signed upon an open tender organised by "Energoatom" Concern" OJSC. The Petitioner took part in the tender but was not pronounced the winner because the Tender Commission of "Energoatom" Concern" OJSC violated the conditions, specified in the tender documentation.

According to FAS Russia, "Energoatom" Concern" OJSC gave advantages to "Khimmash" Group of Machine-Building Plants" CJSC in the tender with the aim to pronounce "Khimmash" Group of Machine-Building Plants" CJSC the winner. There are also signs of "Energoatom" Concern" OJSC and "Khimmash" Group of Machine-Building Plants" CJSC engaging in concerted actions, which led to restricting competition.

FAS Russia incriminates "Energoatom" Concern" OJSC in violating Clauses 2 and 3 Part 1 Article 17 of the Federal Law "On Protection of Competition" in terms of preventing, restricting and eliminating competition by creating advantageous conditions for participating in the tender to a bidder as well as violating the procedures for determining the winner of the tender. FAS Russia also suspects that "Energoatom" Concern" OJSC and "Khimmash" Group of Machine-Building Plants" CJSC violated Part 2 Article 11 of the Federal Law "On Protection of Competition" by engaging in concerted actions that led to restricting competition.
