Court Upheld FAS Decision on Kubanenergosbyt
OREANDA-NEWS. July 14, 2009. The Federal Arbitration Court of the north-Caucasus Districts upheld the rulings of the Arbitration and Appeal Courts on the claim of "Kuban'energosbyt" OJSC. The Courts found the conclusions reached by the Antimonopoly Serivce, valid and legitimate. The cassation appeal of "Kuban'energosbyt" OJSC was dismissed, reported the press-centre of FAS Russia.
In summer 2008, the Krasnodar OFAS Russia initiated antimonopoly proceedings against "Kuban'energosbyt" OJSC, that is the electric power provider of last resort in the Krasnodar region.
Having investigated the case, the Commission of the Krasnodar OFAS Russia pronounced that "Kuban'energosbyt" OJSC had violated Part 1 Article 10 of the Federal Law "On Protection of Competition".
"Kuban'energosbyt" OJSC violated the law by sending letters to "Rossia" Holding Company - Agricultural Firm"Ltd. about concluding a contract for paid services for checking meters and the schemes of their switching in the electric power devices with "Energobalance Kuban", a representative of the network owner ("Kuban'energo" ); and by failure to exercise actions, in accord with Clause 3.1.1 of No. 50531 electric power supply contract of 1st January 2007, related to permissions to use metering devices for calculations at the following facilities: Rossia" Holding Company - Agricultural Firm"Ltd.: Mechanical floor 2 (No.34 TU), warehouse (No.54 TU), Brick Works (No.9 TU).
The Commission of the Krasnodar OFAS Russia issued a determination to "Kuban'energosbyt" OJSC requesting the company to stop violating Part 1 Article 10 of the Federal Law "On Protection of Competition".
