FAS Did not Find Violations in Actions of Molnia Clock Plant
OREANDA-NEWS. July 15, 2009. The Federal Antimonopoly Service (FAS Russia) terminated a case against "Molnia" Chelyabinsk Clock Plant" OJSC, initiated upon a petition of "ROSTVERTOL" OJSC, for violating Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.
"Molnia" Chelyabinsk Clock Plant" OJSC is the only manufacturer of aviation clocks AChS-1MK, used in Mi-28N helicopters. The company has dominant position on the relevant goods market.
According to the Petitioner, "Molnia" Chelyabinsk Clock Plant" OJSC violated the antimonopoly legislation because, having the dominant market position, the company had evaded a contract with "ROSTVERTOL" OJSC for supplying aviation clocks AChS-1MK.
Investigating the case, FAS Russia established that the contract between "Molnia" Chelyabinsk Clock Plant" OJSC and "ROSTVERTOL" OJSC simply had not been formalised; and in reality "Molnia" Chelyabinsk Clock Plant" OJSC has been shipping the products to "ROSTVERTOL" OJSC, executing the necessary documents in accordance with the civil law.
Therefore, it was not being possible to confirm the fact of antimonopoly violations by "Molnia" Chelyabinsk Clock Plant" OJSC.
FAS Russia terminated proceedings on the case.
