OREANDA-NEWS. July 10, 2009. The Federal Antimonopoly Service (FAS Russia) initiated proceedings against "Energoatom" Concern" OJSC and "Biyskenergo" Ltd. for violating Part 1 Article 10 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

"Energoatom" Concern" OJSC is involved in generating electric power within the geographic boundaries of the first price zone for electric power, as well as within the boundaries of the free power transfer zones (FPTZ) - "Kolskaya Energy System", "The Remaining Part of the United Power System of North-West", "The Remaining Part of the United Energy System of the Centre and Nizhny Novgorod Power System", "Rostov and Kalmykia Power Systems", and "Saratov-Balakovo Power District".

Monitoring price bids of "Energoatom" Concern" OJSC, filed to the Trading System Administrator of the wholesale electric energy (power) market for competitive selection of the day-ahead price bids, as well as for competitive selection of the bids for balancing the system for Kolskaya Nuclear Power Station from 1st August to 30th September 2008, showed that in some cases price bids of electric power stations were economically unreasonable.

"Biyskenergo" Ltd. generates electric power within the geographic boundaries of the second price zone and within the boundaries of the free power transfer zone (FPTZ) - "Barnaul-Biysk Power Centre" ("Altai" FPTZ).

Monitoring price bids of "Biyskenergo" Ltd. filed to the Trading System Administrator of the wholesale electric energy (power) market for competitive selection of the day-ahead price bids, as well as for competitive selection of the bids for balancing the system for Biyskenergo Heat Electric Generation Plant from 1st June - 31st August 2008, showed that in some cases price bids of electric power stations were economically unreasonable.

Clause 2 Article 25 of No.35-FZ Federal Law "On Electric Power Industry" of 26th March 2003, established the system of regular control over the wholesale and retail markets, aimed at timely prevention, discovering, limiting and (or) suppressing actions (lack of actions) that have resulted or can result in preventing, restrciting, or eliminating competition and (or) infringing the interests of participants of the electric power industry and consumers of electric power, including price manipulation on the wholesale and retail markets, particularly, abusing company's dominant and (or) unique position.
