OREANDA-NEWS. July 07, 2009. "Kavregiongaz" Ltd. paid a 67 424 560 Rubles fine to the federal budget of the Russian Federation. The third court instance - the Federal Arbitration Court of the North- Caucasus District upheld the sanctions imposed on the company by the Office of the Federal Antimonopoly Service in the Republic of Karachaevo-Cherkessia (OFAS Russia), reported the press-centre of FAS Russia.

In September 2008, the Karachaevo-Cherkessia OFAS Russia found that "Kavregiongaz" Ltd. violated Part 1 Article 10 of the Federal Law "On Protection of Competition" and imposed an administrative fine upon the company. "Kavregiongaz" Ltd. was imposing unfavourable contract conditions upon a counteragent.

FAS Russia would like to remind that the Federal Law "On Protection of Competition" forbids markets participants, that have dominant position, from imposing unfavourable contract conditions upon counteragents or conditions not relevant to the subject matter of the contract. Such conditions can include economically and technologically unjustified and /or requirements for transferring financial assets, other property or property rights that are nor directly specified by legislative normative legal acts, as well as a consent to enter into a contract subject to introducing contract provisions regarding the goods in which a counteragent is not interested, etc.
