Rostechnadzor Executed FAS Decision on Kuznetsk Cement Plant
OREANDA-NEWS. July 07, 2009. The South-Siberian Office of Rostechnadzor executed the FAS Russia's determination on resuming activities of the Kuznetsk Cement Plant, by issuing permission for atmospheric pollutants discharge subject to compliance with the environmental legislation. It enabled the Kuznetsk Cement Plant to resume its work. The FAS Russia's decision and determination have helped saving hundreds of working places in the time of a crisis, reported the press-centre of FAS Russia.
On 16th March 2009, the Federal Antimonopoly Service (FAS Russia) found that the Office of Rospotrebnadzor in the Kemerovo region, the Office of Rostechnadzor in the Kemerovo region, and the Central Office of the Russian Ministry of Emergencies in the Kemerovo region, in the person of the State Fire Supervision Authority of Novokuznetsk, violated Part 1 Article 15 of the Federal Law "On Protection of Competition".
The case was initiated upon a petition of the "Kuznetsk Cement Plant" Production Company" Ltd.
The regional offices of Rospotrebnadzor, Rostechnadzor, and State Fire Supervision Authority in the Kemerovo region violated the antimonopoly legislation by unreasonably preventing economic activities of market participants, which resulted in removing the "Kuznetsk Cement Plant" Production Company" Ltd. from the cement market.
FAS Russia issued determinations which included several measures towards protecting competition on the cement market, in particular, resuming the work of the "Kuznetsk Cement Plant" Production Company" Ltd. subject to absolute compliance with the environmental legislation.
FAS Russia will undertake additional measures to ensure that the determination is executed by all authorities in the Kemerovo region.
