OREANDA-NEWS. June 18, 2009. The Sverdlovsk Regional Arbitration Court confirmed validity of the fine imposed by the Sverdlovsk OFAS Russia upon "Sotrudnichestvo" Ltd. for failure to execute a determination, which several court instances pronounced valid and justified, reported the press-centre of FAS Russia.

In August 2008 the Sverdlovsk OFAS Russia found that "Sotrudnichestvo" Ltd. violated Part 1 Article 10 of the Federal Law "On Protection of Competition" and issued a determination requesting the company to stop the antimonopoly violations. Three court instances confirmed legitimacy of the OFAS Russia's conclusions on the case.

"Sotrudnichestvo" Ltd. violated the antimonopoly legislation by obstructing the energy flow through energy network facilities, owned by "Sotrudnichestvo" Ltd., to "Yekaterinburg" Offset Paper Factory" CJSC at the point of supply, specified in the energy buying-and-selling contract concluded between two legal persons.

In February 2008 the Sverdlovsk OFAS Russia fined "Sotrudnichestvo" Ltd. 300,000 Rubles for failure to execute the determination.

The company disagreed with the punishment and filed a lawsuit to the Arbitration Court. On 10th June 2009, the Sverdlovsk Regional Arbitration Court did not find procedural errors in the legal proceedings on administrative violations and, having analysed the case circumstances, confirmed validity of the fine.
