FAS Found Ministry of Transport Violated Law
OREANDA-NEWS. June 15, 2009. The Federal Antimonopoly Service (FAS Russia) found that the Ministry of Transport, Communications and Road Facilities of the Krasnoyarsk Region and the Ministry of Transport of the Russian Federation violated Part 1 Article 15 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.
The case was initiated upon petitions form individual entrepreneurs involved in road passenger transportation on the Minusinsk - Abakan inter-municipal route. The Agency of Transport, Communications and Road Facilities of the Krasnoyarsk Region (subsequently the Ministry of Transport, Communications and Road Facilities of the Krasnoyarsk Region) withdrew the signature of the Agency's Head and the Agency's stamp from the route passport, based on which the Ministry of Transport of the Russian Federation excluded this route from the General Register of regular bus routes.
In accord with Parts 1, 3 and 5 Article 47, and Part 1 Article 45 of the Federal Law "On Protection of Competition", the case was forwarded for consideration to the federal antimonopoly body.
On 9th June 2009, FAS Russia pronounced that actions undertaken by the Ministry of Transport, Communications and Road Facilities of the Krasnoyarsk Region and the Ministry of Transport of the Russian Federation restricted competition on the market of air passenger transportation and unreasonably prevented economic activities of market participants in violation of Part 1 Article 15 of the Federal Law "On Protection of Competition". FAS Russia issued a determination to the above authorities requesting to stop the violation.
