FAS Initiated Case against Manufacturer of Aviation Clocks
OREANDA-NEWS. May 15, 2009. Having processed a petition of "ROSTVERTOL" OJSC, the Federal Antimonopoly Service (FAS Russia) initiated a case against "Molnia" Chelyabinsk Clock Works OJSC ("Molnia" ChChZ OJSC) for the elements of violating Clause 5 Part 1 Article 10 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.
"Molnia" ChChZ OJSC violated the antimonopoly legislation by infringing the interests of other persons: economically and technologically unjustified refusal to avoid singing contracts with individual buyers (customers).
"Molnia" ChChZ OJSC is the only manufacturer of AChS-1MK aviation clocks used in Mi-28N, and has dominant position on the relevant goods market.
In course of an extended communication between "ROSTVERTOL" OJSC and "Molnia" ChChZ OJSC regarding supplies of AChS-1MK aviation clocks, "Molnia" ChChZ OJSC avoided concluding a contract for supplying AChS-1MK aviation clocks to "ROSTVERTOL" OJSC following various means. Until now the contract has not been signed and "ROSTVERTOL" OJSC has no possibility to buy the products.
FAS Russia is of the opinion that "Molnia" ChChZ OJSC, having dominant position the market of aviation clocks, is trying to avoid signing a contract with "ROSTVERTOL" OJSC for supplying AChS-1MK aviation clocks с "ROSTVERTOL" OJSC.
