OREANDA-NEWS. May 07, 2009. In accordance with No.242 Decree of the Government of the Russian Federation of 17th March 2009 "On Introducing Amendments to Some Acts of the Government of the Russian Federation", the Federal Antimonopoly Service (FAS Russia) amended No.105 Regulations, approved by No.105 FAS Russia's Order of 9th April 2007, reported the press-centre of FAS Russia.

The amendments were introduced to the Rules on drawing up the normative legal acts of FAS Russia and their official registration, approved by No.1009 Decree of the Government of the Russian Federation of 13th August1997, according to which the normative legal acts drawn up by the federal executive bodies must undergo independent examination for propensity for corruption.

To identify the provisions that are conducive to corruption, the draft normative legal acts, except the drafts containing state secrets or confidential information, will be published on the official Internet site of FAS Russia.

The period for independent examination for propensity for corruption shall be no less than seven days.

To prevent including corruption-conducive provisions in the draft normative legal acts, the Guidelines for examining draft normative legal acts and other documents to identify corruption-conducive provisions will be applied in course of drawing up draft normative legal acts. The Guidelines were approved by No.196 of the Government of the Russian Federation of 5th March 2009.

Filing the acts for registration by the Ministry of Justice of the Russian Federation, FAS Russia will submit information on independent expertise, enclosing copies of experts' conclusions. The Ministry can refuse to register a legal act if it establishes that the act in question contains corruption-conducive provisions.

Similar examination must be organized for draft laws.

Currently FAS Russia has adopted the Plan for re-drawing the normative legal acts of the Federal Antimonopoly Service, registered in the Ministry of Justice of the Russian Federation after 30th June 2004.
