OREANDA-NEWS. April 24 2009. The Federal Antimonopoly Service (FAS Russia) formulated the text of the decision and determination on the case initiated against the Federal Customs Service (FTS Russia) for violating the antimonopoly legislation, reported the press-centre of FAS Russia.

On 2nd April 2009, the FAS Russia's Commission found that FTS Russia violated Clauses 2 and 5 Part 1 Article 15 of the Federal Law "On Protection of Competition" by issuing the regulations that resulted (could have resulted) in unreasonably preventing economic activities of market participants as well as restricting the buyers of the goods in their choice of economic entities, selling those goods.

To stop the antimonopoly violations, the FAS Russia's Commission made a decision to issue a determination to FTS Russia on canceling and amending the regulations that breached the antimonopoly violations and on exercising actions towards protecting competition.

In accord with the determination, FTS Russia must by 10th July 2009 introduce amendments to its normative documents that provide for developing competitive environment for the work of the coordinator for emitting customs cards. FTS Russia must present the draft Order for the approval of FASC Russia.

Also by 12th May 2009 FTS Russia must cancel the order on invalidating the order of the Russian State Customs Committee that appointed "Tamozhennaya Karta" Ltd. the coordinator for emitting customs cards.

To ensure market competition, FAS Russia also instructed FTS Russia to send a written notification to the customs bodies by 18th May 2009 on in admissibility of unreasonable refusals to accept customs cards emitted by credit organizations that have a contract for emitting customs cards with "Tamozhennaya Karta" Ltd. and "Tamozhennaya Platezhnaya Sistema" Ltd.

By 16th July 2009, FTS Russia must report on the overall execution of the determination.
