FAS Processes Case against TGK-11
OREANDA-NEWS. On April 17, 2009 the Federal Antimonopoly Service (FAS Russia) processes the case on violating Part 1 Article 10 of the Law "On Protection of Competition" by "TGK-11" OJSC, reported the press-centre of FAS Russia.
"TGK-11" OJSC in involved in generating electric power within the geographic boundaries of the second price zone for electric power as well as within the geographic boundaries of the areas of free power interchange - the "Remaining Integrated Electric Power System of Siberia" and the "Omsk Energy System".
FAS Russia was monitoring the price quotations filed by "TGK-11" OJSC to the wholesale market administrator of electrical energy (power) for competitive procedures of day-ahead selection of price quotations and selection of price quotations for balancing the electric power system at the Omsk TETs-3 (thermal power plant) from 1st June to 31st August 2008, FAS Russia established that some price quotations filed by the electric power station were economically unjustified.
Clause 2 Article 25 of the Law on Electric Power Industry establishes a system for regular control of the wholesale and retail markets, aimed at timely prevention, discovery, restriction and (or) elimination of actions (lack of actions) that result or can result in preventing, restricting or eliminating competition and (or) infringing the interests of economic entities operating on the electric power markets and consumers of electric energy, including price manipulation on the wholesale and retail markets, in particular, abusing the company's dominant and (or) unique position.
