FAS Introduced Amendments to Some Acts of RF Government
OREANDA-NEWS. April 20, 2009. The Federal Antimonopoly Service (FAS Russia) introduced to the Government of the Russian Federation the draft Decree of the Government of the Russian Federation "On Introducing Amendments to some Acts of the Government of the Russian Federation" agreed upon with the interested ministries and governmental agencies as well as with the Bank of Russia, reported the press-centre of FAS Russia.
The draft Decree is drawn up in accordance with the Federal Law "On Introducing Amendments to the Federal Law "On Protection of Competition", which introduced amendments to Article 35 the Federal Law "On Protection of Competition".
The amendments include, in particular, that the normative requirement of the cumulative share of the goods market controlled by financial organizations will be replaced with the threshold assets value of every financial organization - a member of an agreement, exceeding which constitutes the grounds for notifying the antimonopoly body in accordance with Part 9 Article 35 the Federal Law "On Protection of Competition".
The draft Decree determined the threshold assets value of financial organizations according to the balance sheet as at the last accounting date preceding the date when the agreements was concluded, exceeding which the organizations must notify the antimonopoly body in accordance with Part 9 Article 35 the Federal Law "On Protection of Competition":
- 5 billion Rubles -for insurance companies;
- 3 billion Rubles -for leasing companies;
- 1.5 billion Rubles - for non-governmental pension funds;
- 500 million Rubles - for the stock exchange, currency exchange and professional participants of the securities market (except registrars and depositaries);
- 200 million Rubles - for mutual insurance companies, insurance brokers, and credit consumer cooperatives;
- 100 million Rubles - for the managers of the companies of investment funds, mutual funds and private pension funds, specialized depositaries of investment funds, mutual funds and private pension funds, and depositaries;
- 50 million Rubles - for registrars and pawnbrokers' offices.
Normative standards introduced by the draft Decree, are aimed are securing the level of antimonopoly control necessary to prevent monopolistic activities on the market and at the same time avoid excessive administrative regulation.
Adopting the Decree will not require amendments to other regulatory acts or additional expenses from the federal budget.
